Bill Summary: H.R.8387 amends the Immigration and Nationality Act (INA) to expand grounds for inadmissibility, deportation, denial of naturalization, and denaturalization based on membership in, affiliation with, or “advocates for socialist, communist, Chinese communist, Marxist, or Islamic fundamentalist doctrines, parties, or organizations.” The Bill extends these bars - previously limited to immigrants - to all aliens, removes existing exceptions for involuntary membership or membership necessary to obtain food, employment, or other essentials of living, lowers the age exemption threshold from 16 to 14, extends naturalization look-back periods from 10 to 20 years, removes the five-year limitation on denaturalization proceedings, and renders all determinations under its provisions final and unreviewable by any court. Key provisions include making such individuals inadmissible/ deportable and preventing or stripping their naturalization to U.S. citizenship. In doing so it includes all persons who are part of named organizations including the Democratic Socialists of America, various Chinese government-affiliated parties, the Muslim Brotherhood, Hamas, and Hezbollah. Finally, the Bill makes any decisions made under its authority non-reviewable by any court.
Context: H.R. 8387 is McCarthyism supercharged. During the McCarthy era, the McCarran-Walter Act of 1952 authorized the deportation of immigrants and naturalized citizens for their political beliefs and associations, but even then, those targeted could still fight their cases in court. H.R. 8387 removes even that protection, making every determination final and unreviewable by any court. Under this Bill, if an immigrant were to attend a meeting of any of the mentioned groups, that person would become deportable, and without judicial review, they would have no avenue to prove they were unaware they had attended a flagged group, or that they disagreed with its views. H.R. 8387 provides significant power to the President to deport and denaturalize American citizens who protest, write, or post social media content advocating for Palestinian human rights. Political leaders have already publicly accused and attempted to deport Green Card holders for doing so with unfounded accusations of supporting foreign terrorist organizations. This Bill would provide the executive branch with greater power to deport American citizens without any recourse for judicial review.
The acronym of the Bill makes clear that the ‘inspiration’ for this legislation is New York Mayor Zohran Mamdani, using his profile as a means of scapegoating someone who is proudly Muslim, socialist, a democratic socialist, and pro-Palestinian. This is characteristic of this Bill that names Islamic fundamentalism as a target while ignoring all other forms of religious fundamentalism. This Bill seeks to create a system in which a naturalized American citizen of any standing, whether they have lived here for 10 years or 40, can be stripped of their citizenship and deported for sharing content online that the government interprets as advocating undesirable ideas, with no avenue for judicial review, in direct violation of our Constitutional freedoms. H.R. 8387 treats political thought and religious identity as grounds for permanent exclusion from American life, and should be recognized for what it is: an effort to impose a thought police designed to remove anyone certain political interests deems undesirable.
American Values Analysis: H.R. 8387 is repugnant to American values. The Founding Fathers considered political speech essential to a free republic. This bill seeks to suppress the political speech of American citizens that the government deems undesirable. It communicates that American values cannot stand on their own and Americans whose political speech is different than the political majority must be suppressed.
American Interest Analysis: For more than a century the United States has been the premier destination for global talent. It has helped fuel the rise of the United States to superpower status and led to significant technological innovation emerging from American universities and companies. H.R. 8387 would reverse that trend, signaling to the rest of the world that the United States is embracing the trend of countries that fear public debate which differ from the political and religious majority. Therefore, H.R. 8387 stands opposed to American interests

A New Policy opposes H.R. 8387 as it violates the founding promise of American citizenship, empowers the executive to deport and denaturalize Americans for their beliefs and associations, and eliminates any avenue for judicial review.
